I have submitted an original writing, video, artwork, photograph, story or poem in connection with the "rueVolution" promotion. In consideration of the opportunity to potentially have my video posted and/or be included on the rue21 website, sufficiency of which is acknowledged, I, on behalf of myself, and my successors and assigns, agree with and represent to rue21:

I have read, fully understand and agree to be bound by the Submission Guidelines;

I understand that rue21, inc. will have an irrevocable royalty-free license to use, reproduce, alter and/or distribute my submission and the contents of my submission, or make derivative works based on my submission, regardless of whether the submission is selected for inclusion on the website. By making a submission, I hereby irrevocably consent and give permission for rue21 to reproduce, copy, publish or broadcast my name and likeness, in any media for any purpose whatsoever throughout the world;

I agree to sign any additional documents that rue21 determines, in its sole discretion, are necessary for further consideration of my submission;

I understand that rue21 may not select my submission for inclusion, and that the decision of rue21 is final and binding. I also understand that rue21 may, in its sole discretion, cancel, suspend, reschedule or withdraw the submission request or upload process on its website at any time. Uploads may take up to 24 hours to post.

I understand and agree that the use of any of rue's trademarks is permitted only for the purpose of making my submission and that any use beyond this scope is prohibited and may result in legal action against me. I agree that my use of rue's marks will do nothing to deride, defame or damage the marks;

I warrant and represent that the submission is wholly original and created entirely by me, and does not incorporate or include anything that is owned by any third party or entity (with the exception of any rue21 trademarks or merchandise shown in my submission)or which would require the consent of any third party or entity. My submission does not violate any trademark law, copyright law, publicity right, privacy right, or any other right of a third party;

I hereby voluntarily and knowingly release, discharge and relinquish any and all claims, actions and lawsuits of any kind against rue21 related to or arising from the making, taping, use, editing, licensing or distribution of my submission, including, without limitation, any claims, actions or lawsuits for negligence, intentional infliction of emotional distress, defamation, libel, false light, wrongful death, violation of a right of publicity, invasion of privacy, disclosure of embarrassing private facts, fraud, breach of contract, infringement of copyright, and any claims relating to the failure of any equipment that impairs the ability of my submission being uploaded to the internet. I acknowledge and agree that this waiver is an essential and material term of this Release;

I agree that I shall have no right of approval, no claim to compensation or benefit, and no claim arising out of any use or any editing of the submission. My posting is completely voluntary. I am posting my submission with the full understanding that no confidential or other relationship exists between me and rue21;

I represent and warrant that I am at least 16 years old and a legal resident of the United States or the District of Columbia and that I have full, complete and unrestricted right and authority to enter into this release OR if I am a minor, I have parental consent to post my submisssion and my parent or legal guardian has read and agreed to the following statement: I represent and warrant that I am the parent or legal guardian of the minor who is posting this submission, I have read and approve of the foregoing Release, and consent to its execution by my child/ward. I hereby release rue21, inc. from a any claims and/or causes of action and fully and unconditionally guarantee my child/ward's releases and waivers as set forth above.
